US Supreme Court Decision: Trump Has Full Authority To End Education Department
20 states and teachers’ organizations took a stand in court that Trump’s move was an attack on Congress powers.
The US Supreme Court has allowed President Donald Trump to resume measures to dissolve the education department, after which there has been a wave of concern in dozens of states and teachers’ unions.
Of the 9 -member bench of the Supreme Court, 3 Liberal judges opposed the decision, while the majority conservative judges dismissed the federal judge’s decision without explanation, under which hundreds of dismissal employees were ordered.
President Trump promised to terminate the education department during the election campaign and in March 2025 announced the termination of half of the organization’s workforce. He even told his appointed Education Minister Linda Makman: “Make yourself unemployed”.
20 states and teachers ‘organizations took the stand that Trump’s move was an attack on Congress’ powers, as the organization was established in 1979 under an Act of Congress.
Judge Sonia Sutu Mayor said in a controversial note: “Only the Congress has the power to abolish the education department, the court’s silence is a threat to the US constitutional system.”
Remember that most of the primary and secondary education in the United States is financially supported at the state and local level, but federal funding is very important for children with low -income areas and special needs. Also, the role of the federal has been central in the protection of students’ civil rights.
As Trump started the second term in January 2025, all federal agencies instructed all federal agencies to plan a major deduction among employees. The part of these measures is to eliminate the Department of Education, USAID, and diversity programs.
